Everyone needs a basic Will that states how to distribute your property after you die. Without a Will, the Commonwealth of Massachusetts, by statute, will determine who gets your property. It is essential that your Will be reviewed and updated, especially after a divorce. Your Will assigns property to your heirs, and states who will be the guardians of your minor children.
A Durable Power of Attorney is a document that grants another person, the authority to make legal, financial and medical decisions on your behalf, in the event you become incapacitated. Your designated person will be able to pay your bills, continue running your business and plan for medical treatment, if necessary. Without this document, a person will need to be appointed by the Court, which can be lengthy and costly. If you have a Durable Power of Attorney in place, you should review it to make sure that you still want the person you appointed to continue having that authority.
A Health Care Proxy is a document that authorizes someone to make medical decisions for you in the event you are unable. Hospital and medical facilities will not automatically allow your spouse, significant other or children to make these decisions without a Health Care Proxy.
A Living Will is a document that outlines your end- of- life wishes. Although the document is currently not enforceable in Massachusetts, it is an important document because it assists doctors and family members with the types of decisions you would have made.
